Terms And Conditions

1. Introduction

These Terms and Conditions ("Terms") constitute a legally binding agreement between Obazaar ("the Platform", "we", "us", or "our") and you ("Vendor", "Seller", or "you"). By registering, listing products, and selling through Obazaar, you agree to comply with and be bound by these Terms.

These Terms apply to all aspects of your engagement with Obazaar including product listing, order fulfillment, customer communication, pricing, returns, marketing, and payment.


2. Vendor Eligibility and Requirements

To be approved as a vendor on Obazaar, you must:

Be at least 18 years of age and legally able to enter into binding contracts.

Own or represent a home-based business, licensed commercial entity, or freelance business legally operating in Oman.

Provide valid identification, a business license (if applicable), and proof of product ownership or authorization to sell.

Have a valid Omani bank account for receiving payments.

Agree to act in good faith and comply with Omani laws and e-commerce regulations.


Note: Obazaar reserves the right to reject or suspend any vendor that does not meet these requirements, or whose conduct negatively affects customers or the platform.


3. Account Registration and Access

Each vendor is responsible for creating and maintaining a secure vendor account.

The email and phone number provided during registration must remain valid and responsive.

Vendors are responsible for all activities that occur under their account, including product uploads, edits, and responses to buyers.

You may not share, assign, or transfer your account without written approval from Obazaar.


4. Product Listing and Content Requirements

When listing products, vendors must:

Provide accurate product titles, descriptions, specifications, prices, and stock levels.

Upload high-quality images that reflect the actual product, without watermarks or misleading graphics.

Clearly mention product size, weight, usage instructions, and warranty/return policies (if applicable).

Avoid listing items that are:

Illegal, dangerous, counterfeit, or infringe on intellectual property.

Culturally insensitive, religiously offensive, or inappropriate for the Omani/GCC audience.

Explicit or adult content of any kind.

Obazaar reserves the right to remove listings that violate these standards or are flagged by customers.


5. Inventory, Pricing & Fulfillment Responsibilities

You are fully responsible for:

Ensuring accurate and updated stock availability on the platform at all times.

Pricing products fairly and competitively. Prices must be inclusive of any applicable taxes (e.g., VAT).

Fulfilling orders within the promised shipping time (max. 3 days, unless stated otherwise).

Packaging products properly to avoid damage in transit.

If a product is out of stock, you must immediately update the listing to prevent overselling. Failing to fulfill confirmed orders can result in account warnings, temporary suspension, or permanent removal from the platform.


6. Subscription Plans & Commission Structure

A. Free Subscription (Default Plan)

Unlimited product listings.

Basic marketing included in merged ads.

Dynamic commission per sale:

Small cart size (below 10 OMR) → 15%

Medium cart (10–30 OMR) → 10%

Large cart (above 30 OMR) → 5%


B. Paid Subscription (10 OMR/month)

Includes:

Access to reliable packaging and printing suppliers.

Enhanced brand visibility and featured placement.

Monthly marketing boost (free social media promotion or featured listing).

Entry into monthly online business seminars.

Free one-on-one consultation with business experts.

Access to exclusive Obazaar resources and updates.


Note: Paid subscriptions auto-renew unless canceled before the end of the billing period. Vendors may switch plans by contacting support.


7. Order Management & Customer Service

Vendor Responsibilities:

Accept and process orders promptly.

Mark orders as fulfilled with valid tracking or delivery confirmation.

Maintain professional communication with customers.

Address queries, complaints, and disputes politely and within 24 hours.

Cooperate with Obazaar in resolving customer disputes.

Vendors with excessive order cancellations, slow response times, or poor customer feedback may be penalized, downgraded, or suspended.


8. Return, Refund, and Dispute Policy

Obazaar expects vendors to offer return and refund solutions in cases such as:

Product not as described.

Wrong item delivered.

Product damaged during shipping.

Product not delivered.


You agree to:

Accept return requests filed within 7 days of delivery (unless stated otherwise in your listing).

Issue full or partial refunds (as determined by Obazaar or mutual agreement).

Handle disputes professionally and in line with Obazaar's buyer protection policy.

For each returned product, you may be required to cover the cost of return shipping if the fault lies with your listing or delivery.


9. Payouts and Payment Schedule

Obazaar collects payments from customers and deducts platform fees and commissions.

The net amount is transferred to the vendor’s bank account on a [weekly or bi-weekly] basis, depending on your selected payout schedule.

All payouts are subject to minimum withdrawal thresholds (e.g., 5 OMR).

Any delays caused by incorrect bank details or bank-side issues are the vendor's responsibility.


10. Marketing & Promotion

Obazaar may feature your products in promotional campaigns across social media, newsletters, or website highlights.

Vendors may not use Obazaar’s logo or name for independent advertising unless approved in writing.

Paid subscribers will receive additional visibility and tailored promotion via campaigns.


11. Intellectual Property and Content Use

By uploading product images, text, branding, or any other content, you grant Obazaar a non-exclusive, royalty-free license to use, reproduce, and promote your content on all company platforms and media.

You confirm that:

You own or have permission to use the content you upload.

Your listings do not infringe on any third-party rights.


12. Code of Conduct

All vendors are expected to:

Treat customers and Obazaar staff respectfully and professionally.

Avoid manipulative behavior (e.g., fake orders, fake reviews).

Operate with integrity and comply with these Terms.

Violations may result in temporary suspension or permanent ban from the platform.


13. Termination and Suspension

Obazaar may temporarily suspend, limit features, or terminate your account under the following circumstances:

Repeated policy violations.

Fraudulent or illegal activities.

Excessive customer complaints or refund disputes.

Abuse of platform tools or unethical behavior.

You may request account deletion anytime by contacting support, provided that all dues are cleared and pending orders fulfilled.


14. Modifications to Terms

These Terms may be updated or revised at any time. Vendors will be notified through email or platform alerts. Continued use of the platform after changes means you accept the updated Terms.

We recommend you review these Terms periodically.


15. Legal Jurisdiction

These Terms are governed by the laws of the Sultanate of Oman. In the event of a legal dispute, the matter shall be resolved in the appropriate courts within Oman.
